传统民法理论上的法律人格概念关注的是“人在民法中的存在方式”,而“生态人”法律人格表征的则是关于生态文明建设的新诉求。习近平生态文明思想与法治思想的提出对于“生态人”的法律人格塑造提出了更高要求。“生态人”作为一种契合新时代生态文明诉求的人性预设,其法律人格构造更应从生态系统的视角审视人与自然之间的关系。对于“生态人”的法律人格构造,应重点从“生态人”如何成为法律主体、是否具备权利能力以及怎样享有人格利益三个维度进行论证。“生态人”法律人格的塑造,因应了“人与自然和谐共生”诉求下生态环境保护对于“人之形象”的新主张与新期待。
