摘要
“土耳其药品案”是WTO上诉机构停止受理案件以来的第一个上诉案件,并且采用了前所未有的仲裁模式。上诉仲裁基于当事方协议而进行,在程序上有诸多创新之处。在事实认定方面,本案对土耳其药品政策有重要影响。而在法律解释方面,本案也有独到之处,将对未来案件有所贡献。
Turkey-Pharmaceutical Products(DS583)is the first appeal case since the Appellate Body was unable to accept cases in 2019.The arbitration is based on the arbitration agreement between EU and Turkey with some innovative procedural arrangements.The findings of the case will have significant impact on Turkey’s policy and its legal interpretation will contribute to future cases in certain aspects.
