大合规背景下企业环境合规责任——基于煤电企业视角

Corporate Environmental Compliance Responsibilities in the Context of Greater Compliance—Based on the Perspective of Coal Power Enterprises

环境保护力度的加大使煤电等高污染企业的环境责任不断加重,环境污染导致的民事、行政甚至刑事事件,成为企业生产经营必须要面对的重要问题。尽管我国的企业尤其是国有企业已经高度重视企业的合规建设,但是由于刑法、行政法等立法缺少相关的激励机制,使得企业环境合规的内生动力不足,被动履行环境合规责任。因此,应当不断加强企业合规文化建设、制定相对完善的合规计划,使企业形成有效的保护机制。

The increase in environmental protection has made the environmental liability of high-polluting enterprises such as coal power continue to become stricter, and the civil, administrative and even criminal liability caused by environmental pollution has become an important issue that enterprises must face in production and operation. Although Chinese enterprises, especially state-owned enterprises,have attached great importance to the compliance construction of enterprises, due to the lack of relevant incentive mechanisms in legislation such as criminal law and administrative law, the endogenous power of enterprise environmental compliance is insuffi cient,and they passively perform environmental compliance responsibilities. Therefore, we should continuously strengthen the construction of corporate compliance culture and formulate a relatively perfect compliance plan in order to enable enterprises to form an effective protection mechanism and achieve green development.
