Establishment and Construction of Mechanisms for Coordinated Enforcement of Inner-Party Regulations and National Laws

构建党内法规同国家法律协同执行机制是推进党规国法衔接协调的重要内容,是连接党规国法不同运行体系的重要桥梁,是沟通党规国法不同制度逻辑的应有之举,也是推进社会主义法治体系完善的必然要求。党规国法价值取向的一致性、执行对象的竞合性以及党政机构的复合性为构建党规国法协同执行机制提供了可能。植根于中国特定政治社会实践的党内法规同国家法律协同执行机制应坚持党的领导原则、党规国法体系独立运行原则、法治原则以及效率原则。当前,推进党规国法协同执行机制应搭建执规执法协同平台、构建执规执法信息交流共享机制和执规执法案件移送机制。

The construction of a coordination mechanism between inner-Party regulations and national law enforcement is an important part of promoting the convergence and coordination of inner-Party regulations and national laws,an indispensable bridge connecting different operating systems of inner-Party regulations and national laws,a due move to communicate the logic of different systems of inner-Party regulations and national laws,and an inevitable requirement for promoting the improvement of the socialist rule of law system.The consistency of the value orientation of inner-Party regulations and national laws,the competition of enforcement objects,and the complexity of Party and government organs provide a possibility for building a coordinated enforcement mechanism for inner-Party regulations and national laws.The coordination mechanism between inner-Party regulations and national law enforcement rooted in China’s specific political and social practices should adhere to the following principles:CPC leadership,independent operation,rule of law,and enforcement efficiency.Now,the Mechanisms for coordinated enforcement of inner-Party regulations and national laws should be promoted by means of building an enforcement collaborative platform,a mechanism for exchanging and sharing information,and transferring and sorting mechanisms for enforcement cases.
