监察官资格准入制度建立的现实必要与路径选择

Current Status and Path Choice of the Establishment of the Ombudsmen Access Qualification System

监察官作为行使监督、调查、处置职权的国家工作人员,对其职业准入应建立必要的制度设计,进行严格的从业限定。对于是否建立监察官资格准入制度,目前学界有不同的观点,包括是否需要通过法律职业资格考试,是否需要建立独立的监察官资格准入制度等。从监察官队伍专业化建设、监察职权依法行使以及推进反腐败工作法治化规范化等角度来看,建立监察官资格准入制度是十分必要的。结合我国监察工作实际,应建立独立的监察官资格准入制度,即国家统一监察官职业资格考试制度,遵循政治性与专业性相结合、理论性与实践性相结合、公正性与科学性相结合的原则,并进行相关制度设计,以推动建立科学、权威的监察官资格准入制度,不断推进监察官队伍专业化、职业化建设。

As a national employee who exercises supervision,investigation,and maneuver,the ombudsman official candidates shall be strictly limited of their occupational access.The academic community holds different ideas regarding the necessity of establishing an admission mechanism for them including the legal profession examination and an independent mechanism for their admission.As viewed from perspectives of the construction of a professionalized supervisor team,the supervisor power execution and promoting normalization and rule of law within the area of anti-corruption,the above-mentioned mechanism is necessary.With the current status in China considered,an independent ombudsman qualification examination as a unified admission system is imperative,political qualities to be merged with professionalism,theoretical transcendence to be combined with practice,and impartiality and scientific standards jointly considered,so that a scientific and authoritative ombudsman admission mechanism can be promoted for the professionalism and specialized qualities for the team to be continuously improved.
