“三治融合”背景下农村纠纷解决——以新乡贤主体参与为视角

Practice and Reflection on Rural Dispute Resolution under the Background of Three Governance Integration——From the Perspective of New Rural Talents'Participation in Dispute Resolution

农村社会转型期纠纷多元化发展,呈现出新特点,这对农村社会治理提出更高要求,如何发挥自治、法治和德治作用以实现基层善治成为亟待解决的问题。纠纷解决是基层治理的重要内容,新乡贤主体的参与能够有效将纠纷化解在基层,对于推动乡村治理体系现代化,实现乡村善治意义重大。然而,实践中由于受到自治主体缺位、法治建设滞后、德治式微和组织管理落后等因素制约,新乡贤的时代价值并未完全彰显。新时代充分发挥新乡贤解决农村纠纷的作用,需要在“三治融合”框架下,以新乡贤主体培育为核心,加强乡村德治建设和法治建设,搭建起新乡贤化解纠纷的工作平台,创新基层纠纷解决实践,最终实现乡村善治。

During the transition period of rural society,the diversified development of conflicts and disputes presents new characteristics,which puts forward higher requirements for the governance of rural society.Dispute resolution is an important part of grassroots governance.The participation of new rural talents can effectively resolve disputes at the grassroots level,which is of great significance for promoting the modernization of the rural governance system and achieving good rural governance.However,due to the constraints of self-governance,rule of law,rule of virtue and insufficient development of their own organizations in practice,the era value of new rural talents has not been fully demonstrated.In the new era,to give full play to the role of new rural talents in resolving disputes in rural areas,it is necessary to strengthen the construction of rural morality and the rule of law under the framework of"integration of three governances",with the cultivation of the main body of new rural talents as the core,and to build a working platform for new rural talents to resolve disputes,to innovate grassroots dispute resolution practices and achieve good rural governance.
