摘要
中国的生态修复工作已经取得历史性成就,生态修复相关法律法规主要分为综合型、要素型、区域型和污染防治型。但由于立法理念相对滞后,配套法规不健全,因而亟须完善和健全生态修复相关的法律法规体系,完善的法律法规体系是高质量生态修复的基石。因此,首先需要制定生态修复基本法,完善配套性法律法规,并且加强对传统立法的生态化改造,完善地方性法规,健全法律法规的执行与监督机制。
China has made historic achievements in ecological protection and restoration.Laws and regulations related to ecological restoration can mainly divided into comprehensive type,factor type,regional type and pollution prevention and control type.However,due to the lagging legislative concept and imperfect supporting laws and regulations,it is urgent to improve and perfect the relevant laws and regulations system of ecological restoration,which is the cornerstone of high-quality ecological restoration.Therefore,we need to formulate the basic law of ecological restoration and supporting regulations,strengthen the ecological transformation of traditional legislation,and improve local regulations and the implementation and supervision mechanism of laws and regulations.
