有关延长中医药传统知识保护期限问题的探讨

中医药传统知识具有极大的经济价值和社会价值,是中华民族的瑰宝,它的最大特点是传承性和延续性。目前我国对中医药传统知识的保护多使用现代知识产权保护制度,保护期限较短,与中医药的传承性和延续性特点相悖,不能达到较好保护中医药传统知识的目的。当前,中医药传统知识保护面临许多困难与挑战,传承与保护工作不力,致使许多中医药传统知识濒临亡失。中医药传统知识的许多问题亟待解决。因此,制订符合中医药特征的保护制度,延长保护期限,对于保护中医药传统知识和推进健康中国目标的完成具有重要意义。

Traditional knowledge of traditional Chinese medicine has great economic and social value,and it is a treasure of the Chinese nation.Its most important feature is inheritance and continuity.At present,the protection of traditional knowledge of traditional Chinese medicine in my country mostly uses the modern intellectual property protection system,and the protection period is short,which is contrary to the inheritance and continuity of traditional Chinese medicine,and cannot achieve the purpose of better protection of traditional knowledge of traditional Chinese medicine.At present,the protection of traditional knowledge of traditional Chinese medicine is facing many difficulties and challenges,and the lack of inheritance and protection has led to the imminent loss of many traditional knowledge of traditional Chinese medicine.Many problems with traditional knowledge of traditional Chinese medicine need to be solved urgently.Therefore,formulating a protection system that conforms to the characteristics of traditional Chinese medicine and extending the protection period are of great significance for protecting traditional knowledge of traditional Chinese medicine and promoting the achievement of the goal of a healthy China.
