投诉举报人原告资格认定标准重构

摘要 投诉举报行政诉讼中,投诉举报人多以行政机关作出的投诉举报答复为起诉对象。投诉举报答复兼具投诉举报请求权意义上的实体性与相对于投诉举报事项实体处理结果意义上的程序性。实体性视角下,司法机关应坚持对原告资格的概括性赋予。程序性视角下,人民法院有必要根据投诉举报答复与投诉举报事项实体处理的“紧密关联性”标准认定投诉举报人原告资格,并在该标准的适用中全面引入保护规范理论。 In the complaint and report administrative litigation,the complaint informant mostly takes the reply made by the administrative organ as the object of prosecution.The response to complaints and reports is both substantive in the sense of the right of complaint and report and procedural in the sense of the entity handling result of complaints and reports.From the perspective of entity,judicial organs should insist on the generality of the qualification of plaintiff qualification.From the perspective of procedure,it is necessary for the people’s court to identify the complainant informant’s plaintiff qualification according to the“close correlation”standard of complaint response and complaint reporting handling,and comprehensively introduce the theory of protection norms into the application of this standard.
