新型电信网络诈骗犯罪治理的路径探索

New Telecom Network Fraud Crime Governance

近年来,电信网络诈骗犯罪受到严厉打击,但依然猖獗,犯罪活动不断演化、升级,网络化、虚拟化、牟利大等特点更加突出,严重污染网络空间生态环境,严重影响广大人民群众的安全感和国家经济社会的健康有序发展,亟需加强治理。目前新型网络诈骗犯罪治理面临机制建设有待健全、法律体系不够完善、宣传防范缺乏针对、行业监管积弊较多和打击难度不断增加等问题。对此,应着重从以下方面提高治理水平和能力,一是党政主导、共治共管,探索新型网络诈骗犯罪切实有效的基层治理办法,二是动态治理、因势利导,探索新型网络诈骗犯罪切实有效的社会综治效果,三是创新宣教,打防并举,探索新型网络诈骗犯罪切实有效的打击防范措施。

The telecom network fraud crime has been severely cracked down on in recent years.But the criminal activities are still rampant,continuing to evolve and upgrade,with prominent characteristics such as network-based,virtualization,and profiteering,which seriously pollutes ecological environment in network space,seriously affect se⁃curity sense of the people and the healthy and orderly development of the national economy and society.Therefore,it is urgent to strengthen governance of telecom network fraud crime.However,the governance is faced with problems such as the need to improve the mechanism construction,the imperfect legal system,the lack of publicity and preven⁃tion,the accumulated disadvantages of the industry supervision and the increasing difficulty of cracking down.In this regard,we should focus on the following aspects to improve the level and ability of governance.The first is to explore effective grass-roots governance methods based on leading of the party and government,and co-governance and joint management.The second is to explore practical and effective social comprehensive treatment based on dynamic gover⁃nance.The third is to explore effective combat and prevention measures based on innovation of publicity and educa⁃tion,combating and preventing simultaneously.
