网络零包贩毒综合治理路径探索

随着信息时代的快速发展,传统的线下零包毒品交易逐渐向互联网迁移,网络零包贩毒增多。这类犯罪主体普遍年轻,涉毒前科人员再犯比例高,犯罪手段更加隐蔽、智能化程度更高,跨区域犯罪明显增加,通过寄递渠道运输的毒品种类不断增多。职能部门在治理该类案件过程中,面临着寄递毒品的运输环节管理难、网络取证专业人才缺乏、案件线索来源单一、取证难度大等诸多现实挑战。为有效应对挑战,职能部门应加强物流行业监管、强化网络空间管控、增强对网约车的监督、提升对电子证据的收集和运用、激活办案数据预判作用,施行整合治理。

With rapid development of the information age,traditional off-line minute amount drug trade gradually migrated to the internet,and online minute amount drug trafficking increased.The subjects of such crimes are general⁃ly young,with a high proportion of recidivism among former drug-related offenders.The means of crime are more con⁃cealed and more intelligent.Trans-regional crimes have increased significantly,and the types of drugs transported through delivery channels have been on the rise.In the process of handling such cases,the functional departments are faced with many practical challenges,such as difficult management of the transportation link of drug delivery,lack of professionals in network forensics,single source of case clues and difficulty in obtaining evidences.Comprehensive gov⁃ernance system should be implemented in order to effectively cope with the above challenges.For example,the supervi⁃sion of logistics industry and the control of cyberspace should be strengthened,the supervision of online car booking should be enhanced,the collection and application of electronic evidence should be improved,and the prediction func⁃tion of case handling data should be activated.
