国际视角下外资安全审查制度3.0版的新发展及其因应

New Developments and Countermeasures of Foreign Investment Security Review System Version 3.0 from an International Perspective

2017—2021年欧美部分发达国家修改外资立法,在诸多方面升级了外资安全审查措施,形成了外资安全审查制度3.0版。从其外资立法修改的动因来看,外资安全审查制度3.0版将成为这些国家与中国等新兴经济体竞争的工具,给我国境外投资及全球战略带来较大挑战。文章梳理了外资安全审查制度不断升级的历程,阐释了外资安全审查制度3.0版较早先版本的主要特征,进一步探讨了外资安全审查制度3.0版升级对我国境外投资的影响。在此基础上,从政府和投资者两个层面提出多维度的因应策略,以期缓解我国境外投资被围困的局面。

From 2017 to 2021,some developed countries in Europe and the United States revised foreign in-vestment legislations which upgraded foreign investment security review measures in many aspects.Therefor foreign investment security review system version 3.0 is formed.From the perspective of the motivation for the revision of their foreign investment legislation,the foreign investment security review system version 3.0 will become a tool for these countries to compete with China and other emerging economies,and will bring great challenges to China's overseas investment and global strategy.The article summarizes the progress of the continuous upgrading of the for-eign investment security review system,explains the main features of the foreign capital security review system ver-sion 3.0 compared with the previous version,furtherly discusses the impact of the upgrading of the foreign capital security review system version 3.0 on China's overseas investment,and on this basis,puts forward multi-dimen-sional response strategies from the two levels of the government and investors in order to alleviate the besieged situa-tion of China's overseas investment.
