结构功能主义视角下村规民约制定中的问题及优化路径

Problems and Optimal Paths in the Process of Making Village Regulations and Non-governmental Agreements from the Perspective of Structural Functionalism

村规民约是基层治理格局中的重要因素,在维持农村社会稳定、调解矛盾纠纷,推动移风易俗方面发挥了很大的作用。但是其制定的程序合法性、内容合理性、制定过程的协同性以及自主创造性方面存在一些问题。鉴于此,以结构功能主义理论为视角结合A省村规民约的制定状况,分析村规民约制定过程中存在的现实梗阻,从适应、目标实现、整合、潜护四个层次探索完善基层村规民约制定和落实的路径,以此来规范村规民约的制定落实,使其基层治理、维持社会稳定的作用真正发挥。

Village regulations and folk agreements are an important factor in the grassroots governance structure,and they play a significant role in maintaining social stability in rural areas,mediating conflicts and disputes,and promoting changes in customs.However,there are some problems in the legality of the procedure,the rationality of the content,the coordination of the formulation process,and the independent creativity.Because of this,from the perspective of structural functionalism theory,explore the process of making village regulations and folk regulations,analyze the actual obstacles in the process of making village regulations and folk regulations,and explore and improve the grassroots village regulations from four levels of adaptation,goal realization,integration,and protection.The path for the formulation and implementation of conventions is used to standardize the formulation and implementation of village regulations and folk conventions,so that the role of grassroots governance and the maintenance of social stability can be truly brought into play.
