从最佳起点考量最接近现有技术的选取

摘要 创造性审查是发明专利实质审查过程中极为重要的环节,确定最接近的现有技术是评判创造性所采用的“三步法”的首要步骤,作为重塑发明的起点发挥着相当重要的作用。本研究通过两个案例阐明最接近的现有技术应该是完成要保护发明创造的最佳起点,以技术领域、技术问题、技术效果、技术特征四个维度全面考虑,以发明构思综合考量,希望以最小的跨度和改进到达发明创造的终点。以贴近发明人的思维逻辑重塑发明过程,才能更加符合“三步法”的实质,保证创造性评判的客观性。 The creativity examination is the focus of the substantive examination process of invention patents.Selecting the closest prior art is the first step of the "three-step approach" used to judge creativity and plays a crucial role as a starting point for reshaping inventions.This paper discusses that the closest prior art which comprehensively considers technical fields,technical problems,technical effects,and technical characteristics should be the best starting point for inventions and creations with two cases.In order to better conform to the essence of the "three-step approach" and ensure the objectivity of creativity judgement,we should comprehensively consider the invention concept,expecting to reach the end of invention with the smallest span and improvement and reshape the invention process with the thinking logic close to the inventor.
