在枪支管理制度构建中,法律责任的追究机制是一个核心环节。非法涉枪法律责任之追究机制的构建,首先有赖于对其法律责任之体系结构的明晰。在我国现行的法律制度下,非法涉枪法律责任之体系结构涉及法律责任的类型以及不同法律责任间的关系。在此基础上,需要确立非法涉枪法律责任的追究原则:在行政优先的大前提下,进行效果考量,并保持司法的必要谦抑。在实现路径上,在非法涉枪行为需要同时承担行政责任与刑事责任的情况下,合理确立相应程序的先后关系,在二者聚合成立时协调处断。
