摘要
公共信用信息的归集工作与共享开放之间一直存在着依据存疑、动力匮乏和标准不一等制度衔接问题。法理层面,公共信用信息共享开放能够促进区域协同发展、提升跨部门资源整合能力、推动服务型政府的转型升级以及降低信息不对称实现社会治理;法律控制层面,公共信用信息共享开放必须遵循“把公民基本权利放在首位”的原则,通过类别化处理信用信息、夯实各部门责任、培育要素市场等方法,构建和完善公共信用信息共享开放制度。
Between the collection of public credit information and the sharing and opening,there have always been problems of institutional connection,such as doubtful basis,lack of motivation and inconsistent standards.At the legal level,the sharing and opening of public credit information can promote the coordinated development of regions,improve the ability of interdepartmental resource integration,promote the transformation and upgrading of service-oriented government,and reduce information asymmetry to achieve social governance.From the perspective of legal control,the public credit information sharing and opening must follow the principle of“putting the basic rights of citizens in the first place”,and construct and consummate the public credit information sharing and opening system through the methods of categorizing credit information,consolidating the responsibilities of various departments,and cultivating factor markets.
