A Research on the System of Indemnity Deposit in the View of the Criminal Judicial Policy of“Less Arrest,More Cautious Prosecution,and More Cautious Custody”

推行赔偿保证金制度对于落实“少捕慎诉慎押”刑事司法政策、推进认罪认罚从宽制度、提高刑事和解成功率以及实现司法公正具有积极作用。作为实践中不断探索的诉讼性制度,赔偿保证金制度在使用中仍存在一些问题,应从适用案件范围、适用诉讼环节、保证金数额确定、保证金缴存和保管方式、程序适用的风险防控等方面进行全流程、系统的完善。

The implementation of the system of indemnity deposit plays a positive role in the implementation of the criminal judicial policy of“less arrest,more cautious prosecution,and more cautious custody”,the promotion of the system of leniency in guilty plea,the improvement of the success rate of criminal reconciliation and the realization of judicial justice.As a litigation system which is constantly explored in practice,there are still some problems in the system of indemnity deposit,we should perfect the whole process and system from the aspects of applicable case scope,applicable litigation procedures,determination of deposit amount,ways of deposit and safekeeping,risk prevention and control.
