摘要
“双减”政策对我国校外教育培训机构监管提出新的挑战。推动校外教育培训机构监管立法既是规范校外教育培训市场秩序的必然要求,也是推进依法行政和依法治教的内在动力。国家对校外培训机构治理的重视和已有的立法基础证明立法时机已经成熟。校外教育培训机构监管立法首先应处理好立法名称、调整对象、模式选择及其在教育法中的地位等理论定位问题,并确立倾斜保护原则、属地管理原则、全过程监管原则和合作治理原则等立法原则。在此基础上,应从总则部分的构成要素、变更与终止规则、监管工具、法律责任条款、监管权力规制体系等方面进行制度建构。
The“double reduction”policy poses new challenges to the regulatory transformation of education and training institutions outside school.Promoting the supervision and legislation of these institutions is not only the inevitable requirement of regulating the market order of off-campus education and training,but also the internal motivation of promoting the administration and education by law.The attention to the management of off-campus training institutions and the existing legislative basis prove that it is high time to the legislation.Firstly,we should deal with the problems of theoretical positioning such as the legislation name,adjusted object,mode selection and its position in education law,then the legislative principles of preferential protection,territorial management,whole-process supervision and cooperative governance should be established.On this basis,the system should be constructed from the elements of the general provisions,the rules of setting changes and terminations,the regulatory tools,the legal liability clauses,the regulatory power system and so on.
