摘要
在互联网快速发展与信息化推进的趋势下,网络直播行业在我国出现。在带来机遇的同时,网络直播行业也给著作权领域带来挑战,其著作权的认定也存在不少争议。故以争议最多的三种直播类型为例,论述网络直播画面的著作权认定与权利归属问题。网络直播画面属于作品,具体而言,可以将其认定为视听作品,受到《著作权法》保护。其权利归属,因直播类型的不同而有所不同。
With the rapid development of the Internet and the advancement of informatization,the network live broadcast industry has emerged in China.While bringing opportunities,the webcasting industry has also brought challenges to the copyright field,and there are many controversies in the identification of its copyright.Therefore,take three most controversial live broadcast types as examples,and will discuss the copyright the copyright identification and attribution of live webcast images.Live webcasts belong to works,and they can be regarded as audiovisual works and are protected by the Copyright Law.The attribution of their rights varies according to the type of live broadcast.
