专断医疗行为有可能成立过失犯罪 被引量:4

Unauthorized Medical Treatment May Create Negligent Crimes

摘要 专断医疗行为是指在没有获得病患同意的前提下,医师擅自展开的针对病患的医疗救助行为,其造成患者利益严重受损的情况是否应当依据刑法进行处理在刑法理论界存在“无罪说”“有罪说”和“部分有罪说”。由于专断医疗行为是医师出于正当的医疗目的而实施,因而即使其造成严重后果也不可能成立故意犯罪,但存在成立过失犯罪的可能性,而医师产生过失犯罪是因为违反了应尽的注意义务。针对专断医疗行为,只有当未征得患者同意所进行的医疗行为导致患者重伤或者死亡的严重后果,且医师的医疗行为存在瑕疵(违反注意义务、不符合医疗技术规范)时,才成立过失犯罪。 Unauthorized medical treatment refers to the medical behavior performed by a doctor without the consent of the patient.With regard to whether it should be dealt with in accordance with the criminal law in the case of serious damage to the interests of the patient,there are theories of innocence,guilt and compromise theory.Since unauthorized medical treatment is carried out by doctors for legitimate medical purposes,it is impossible to establish an intentional crime even if it causes serious consequences,but the possibility of establishing a negligent crime exists.The essence of negligent crime is that the perpetrator violates the relevant duty of care.In the case of unauthorized medical treatment,negligent crime is only established when the medical behavior without the consent of the patient results in serious injury or death of the patient,and the doctor’s medical behavior is fl awed,such as violation of the duty of care and noncompliance with medical technical standards.
