高等教育执法检查如何做?——基于《高等教育法》实施情况报告的文本分析

2019年6月,《高等教育法》颁布20年以来,全国人大常委会首次对其开展了执法检查。基于权力机关进行高等教育执法检查功能的理论框架,利用NVivo11对《全国人大常委会执法检查组关于检查<中华人民共和国高等教育法>实施情况的报告》(简称为《报告》)文本进行质性分析,得出结论:本次《高等教育法》执法检查的重点是促进高等教育事业发展,未能凸显发现并解决执法的制度障碍这一功能。同时,在《报告》中未对如何修订《高等教育法》形成具体的建议,未有效地发挥促进高教法律制度完善的作用。本文旨在拓宽对高等教育执法检查工作理论与实践的认识,进一步探讨高等教育执法检查工作的有效策略机制。

In June 2019, twenty years after the launch of Higher Education Law, National People’s Congress(NPC) Standing Committee conducted its first law enforcement inspection. Based on the theoretical framework of the role for law enforcement inspections in higher education, this research makes a qualitative analysis of the First Law Enforcement Inspection Report based on the Higher Education Law and draws the conclusion that the Report based on the Higher Education Law focuses on promoting the development of higher education, without emphasizing the function of finding and solving the institutional obstacles of law enforcement. At the same time, the Report does not put forward specific proposals on how to amend the Higher Education Law, and does not effectively promote the improvement of the legal system of higher education. Therefore, this paper aims to broaden the understanding of the theory and practice of higher education law enforcement inspection, and further explore the effective strategy mechanism of higher education law enforcement inspection.
