摘要
“十四五”时期的中国将进一步吸收全球人才和技术,更加广泛地利用好本国市场,为知识资本和人力资本提供更大的发展机遇。在这种背景下,本文梳理了改革开放后我国移民法律制度的演变和人才引进政策的现状。研究发现,我国现行移民法律规范缺失移民等相关概念的法律定义,整个移民法律规范体系尚处于较为稚嫩、零散的状态,其规范目的与人才引进政策的实践需求不相适应。本文认为,在未来的移民立法与人才引进政策的实践中,助力对外开放、维护国民利益是重要目的和价值追求,构建移民法典是逐步完善移民法律规范体系的最终目标。
In the 14th Five-Year Plan period,China will absorb talents and technologies from all over the world,make better use of its domestic market,and provide greater development opportunities for intellectual capital and human capital.In this context,this paper summarizes the evolution of China’s immigration legal system and talent introduction policy after the reform and opening up.It is found that the current legal norms of immigration in China lack legal definitions of relevant concepts such as immigration,the whole legal norms system of immigration is still in a relatively immature and scattered state,and its normative purpose does not meet the practical needs of talent introduction policy.This paper holds that in the practice of immigration legislation and talent introduction policy in the future,it is an important goal and value pursuit to help the opening up and safeguard national interests,and the construction of immigration code is the ultimate goal of gradually improving the legal system of immigration.
