电商平台中消费者权益保护问题研究——以“二选一”行为为例 被引量:1

摘要 电子商务在近几年发展较快,势头迅猛,电商平台“二选一”模式进入人们的视野,在互联网领域具有绝对支配地位和掌握核心信息的电商平台经营者,通过对平台用户、商家实行“二选一”的方式,获取自身利益的最大化,该行为看似保证了消费者的自主选择权,其实被剥夺,扰乱电商市场秩序、损害消费者的合法权益。2021年初开始,国家已经对“二选一”行为进行了整顿,但“二选一”行为仍然存在。本文从电商平台的现状入手,分析成因,借助《反垄断法》修改的契机,完善反垄断规制,保护电商平台消费者权益。 E-commerce has been developing rapidly in recent years,and the“A or B”model of e-commerce platforms has come into being.The“A or B”model has been used by e-commerce platform operators with dominant position and core information in the field of the Internet to maximize their interests by imposing“A or B”on platform users and merchants,which seems to guarantee consumers’rights to choose,but is deprived of their rights,disrupting the e-commerce market order and damaging consumers’legitimate rights and interests.Since the beginning of 2021,China has rectified the“A or B”model,but it still exists.In this paper,we analyze the causes of the current situation of e-commerce platforms and take the opportunity of the revision of the Anti-monopoly Law to improve the anti-monopoly regulations and protect the rights and interests of consumers in e-commerce platforms.
