比较法视角下医师法律制度完善研究——兼论《医师法》和相关法律的衔接

Research on the perfection of physician legal System from the perspective of comparative law——Also on the connection and complement between the Law on Physician and other laws

《医师法》的实施为保障医师合法权益,规范医师执业行为,加强医师队伍建设,促进健康中国建设提供了有力的法律保障。但是,《医师法》尚存在一些不足之处:医师定义和范围过窄、医师权利不全面、法律责任不严谨等。提出丰富医师内涵、完善医师权利、厘清法律责任、做好和其他法律的衔接等建议,切实将法律的制度优势转化为治理效能。

The implementation of the law is to protect the legitimate rights and interests of doctors,standardize the practice of doctors,strengthen the ranks of doctors,provide a strong legal guarantee for the construction of Healthy China.But,there are still some deficiencies in the Physician Law,too narrow definition and scope for physicians、physician’rights not comprehensive、legal liability not rigorous Etc.The article proposed to enrich the connotation of physician,improve the rights of physician,clarify legal responsibilities,make good connection with other laws,to effectively transform the legal system advantage into governance efficiency.
