Retrospect and Prospect on the Construction of the Rule of Law in National Supervision in the New Era

监察体制改革是我国健全与完善党和国家监督体系的重要举措。在改革前,我国便已具有了深厚的监察法治基础。十八大以来,新时代监察法治建设历经了积累、创制和深化三个辩证发展阶段。在全面从严治党和反腐败斗争形势的不断推进下,监察体制法治化革新应运而生,这不仅是宪法框架下的制度改革,更是通过以纪入法的方式,实现了党对反腐败工作统一领导的制度化与法治化。监察法治建设从传承到革新,是从成熟到深化的历程。对十年来的监察法治建设作出系统性回顾,评估已取得的成效和经验,是展望监察法治建设的基础。党的二十大报告中“党的自我革命”提法为监察法治建设指明了发展方向。未来,应当持续优化监察制度规范体系与监察权的合理配置;完善派驻监督体制机制,做好“后半篇文章”;精准有效运用监督执纪“四种形态”,净化产生腐败问题的土壤。

The reform of the supervision system is an important initiative to improve the supervision system of the Party and state in China.Before the reform,China already had a deep foundation for the rule of law in supervision.Since the 18th CPC National Congress,the construction of the rule of law for supervision in the new era has gone through three dialectical stages of development:accumulation,creation and deepening.Under the continuous promotion of full and strict governance over the Party and the situation of fighting corruption,the innovation of the rule of law in supervision system emerged,which is not only a reform of system of Constitution,but also realizes institutionalization and legalization of the leadership of anti-corruption work by means of incorporating discipline into the law.The construction of the rule of law in supervision is a journey from heritage to innovation,and from maturity to deepening.A systematic review of a decade of construction the rule of law in supervision is necessary.And an assessment of the results and experience gained is the basis for future construction of the rule of law in supervision.The“self-reform of the Party”proposed by the report of the 20th CPC National Congress provides a guiding direction for the development of the construction of the rule of law in supervision.In the future,we should continue to optimize the national supervision system and the rational allocation of the power of supervision;improve the system and mechanism for accredited institution,and do a good job of the“second half of the article”;and precisely and effectively exercise the“Four forms”of discipline supervision and enforcement to purify the breeding grounds for corruption.
