新《职业教育法》:修订历程、内生逻辑与价值追求 被引量:13

New Vocational Education Law: Revision Process, Endogenous Logic and Value Pursuit

摘要 新《职业教育法》的修订历经坎坷,艰难地致力于寻找各方意见的平衡点与突破口,经过奠基阶段、复修阶段、生成阶段三次修订中的一系列反复曲折的立法过程之后,最终才得以顺利落地。在漫长的修订历程中,以立法逻辑规范为起点的法理逻辑、以理论实践成果为基础的学理逻辑以及以解决现实问题为核心的事理逻辑共同构成了新《职业教育法》的内生逻辑。基于法律内容,新《职业教育法》为职业教育改革和发展提出了新的制度安排,在责任担当上强化发展职业教育的国家义务;在目标构想上追求高质量的职业教育体系;在行动路向上优化职业教育的治理模式。 The revision of the new Vocational Education Law experienced ups and downs, it is hard to find the balance point and breakthrough of the opinions of all parties. After a series of repeated and tortuous legislative processes in the three revisions of the foundation stage, the rehabilitation stage and the generation stage, it can finally be implemented. In the long course of revision, the juristic logic starting from legislative logical norms, the academic logic based on the theoretical and practical achievements and the practical logic centered on solving practical problems constitute the endogenous logic of the new Vocational Education Law. Based on the content of the law, the new Vocational Education Law puts forward new institutional arrangements for the reform and development of vocational education, and strengthens the national obligation to develop vocational education in terms of responsibility;pursue high-quality vocational education system in goal conception;optimize the governance mode of vocational education on the action path.
