央地共治下的自然资源用途管制优化研究

Optimization of Natural Resources Regulation under the Co-governance of Central and Local Governments

文章以央地关系为研究视角,探索央地共治下自然资源用途管制的优化方向,为自然资源统一管理提供理论支撑。当前我国自然资源用途管制虽然从机构上实现了统一,但仍存在中央地方事权划分不清晰、缺少系统设计的全流程用途管制规则、刚性控制和弹性管理协调不够、缺少“政府引导+市场主导”的复合型配套政策等结构性问题。在推进简政放权、放管结合,实现央地共治的新时代背景下,合理划分中央和地方的管制事权是实现自然资源用途管制的前提及基础。文章提出要分别在分区管理、空间准入、用途转用、开发利用监管、利益协调等方面明晰省级以上事权和地方事权,推进自然资源领域的治理体系和治理能力现代化。

The purpose of this study is to explore the optimization direction of the regulation of natural resources under the joint governance of central and local governments,so as to provide theoretical support for the unified management of natural resources from the perspective of the relationship between central and local governments.Although the use regulation of natural resources is unified in terms of institutions,there are still structural problems such as unclear division of central and local powers,lack of systematically designed whole process use regulation rules,insufficient coordination of rigid control and flexible management,and lack of compound supporting policies of government guidance and market dominance.In the new era of promoting the simplification and decentralization of administration,and realizing the joint governance of central and local governments,the rational division of central and local regulatory powers is the premise and foundation of realizing the use regulation of natural resources.The paper puts forwards some suggestions in zoning management,space access,use diversion,development and utilization supervision,and interest coordination,to promote the modernization of governance system and governance capacity in the field of natural resources.
