国际贸易争端视角下国际条约适用的实践研究

Practical Study on the Application of International Treaties from the Perspective of International Trade Disputes

随着“一带一路”和国际国内双循环倡议的提出,大大促进了我国对外进出口贸易的发展,但贸易交往中的摩擦与争议也成为我国与贸易各国面临的重要问题。在解决国际商事争议的过程中,国际条约的适用问题至关重要。从国际贸易争端解决的法律实务视角,简要介绍我国司法实践中适用民商事国际条约的基本情况,进而探讨在民法典实施后,涉外商事案件适用国际条约时的司法适用、国际条约的法律位阶等问题,最终提出适用国际条约解决国际贸易争端的实践建议,进行国际条约履约实践的实证研究,达到促进和提升国际条约履约效能的目的,从而助力我国对外贸易的高质量发展。

With the proposal of the"the Belt and Road"and the international and domestic double circulation initiative,Chin′s foreign import and export trade has been greatly promoted,but the friction and dispute in trade exchanges have also become an important issue of China and other trade countries.In the process of resolving international commercial disputes,the application of international treaties is of vital importance.From the perspective of the legal practice of international trade dispute settlement,this paper briefly introduces the basic situation of the application of international treaties in civil and commercial matters in China′s judicial practice,and then discusses the judicial application of international treaties in foreign-related commercial cases after the implementation of the Civil Code,the legal hierarchy of international treaties and other issues,finally puts forward practical suggestions on the application of international treaties to resolve international trade disputes and conducts empirical research on the implementation of international treaties,to achieve the purpose of promoting and enhancing the performance of international treaties,thereby contributing to the high-quality development of China′s foreign trade.
