摘要
中国企业在“一带一路”沿线国家的投资,受行业、政治环境、外部因素影响而面临人权风险,预防人权风险、承担人权责任,成为中国企业必须重视的现实问题。企业人权责任经历了规制主义和共治主义的交错发展,从《联合国工商业与人权指导原则》开始走向“多中心治理”,成为全球企业必修的课题。当前,中国企业承担人权责任在能力建设、行为模式转换、同利益相关者关系建设等方面面临挑战。中国应当制定并且执行相关法律与政策,加大对人权责任的宣传以监督和强化企业的负责任行为;企业应当履行人权尽责,注重同东道国利益相关者的联系,增强能力建设,在经营管理的各环节尊重人权。
Chinese corporations investing in countries along the“Belt and Road”are facing human rights risks due to the elements of industry,political environment and external factors.Preventing human rights risks and assuming human rights responsibility have become a practical problem that Chinese corporations must pay attention to it.After the staggered development of regulalism and synarchism,With the introduction of the Guiding Principles on Business and Human Rights for implementing,The UN Protect,Respect and Remedy Framework,Corporate human rights responsibility has been going towards the multi-center governance,which has become a required course for global enterprises.Chinese corporations assuming human rights responsibilities face challenges in capacity building,transformation of behavior mode and relations building with stakeholders.The State shall formulate and implement relevant laws and policies,increase the publicity of human rights responsibility to supervise and strengthen the responsible behavior of enterprises;Corporations shall fulfill human rights responsibility,pay attention to contact with host country stakeholders,enhance capacity building,and respect human rights in all aspects of their operation and management.
