日本亲台势力炮制“与台湾关系法”析论

An Analysis of Japan’s “Taiwan Relations Act” Crafted by Pro-Taiwan Forces

长期以来,日本国内右翼亲台势力持续以“规范台日关系”为由,企图效仿美国推动制定日本版“与台湾关系法”,立法进程相继经历“亲台学者酝酿”、“右翼团体推动”以及“议员政治操作”等阶段。通过梳理日本“亲台”势力推动涉台立法的历史经纬和主要内容,可以看出虽然日本涉台立法版本层出不穷,但是始终围绕“台湾地位、情报共享及安全合作”等明显违反“一个中国”原则的敏感议题。反华学者、右翼智库以及亲台议员等充当鼓动涉台立法的主要幕后势力。在中美战略博弈背景下,日本推动涉台立法呈现“由暗转明”的态势,使危害中日关系的涉台法律风险再次“浮出水面”。

For a long time,the right-wing “pro-Taiwan” forces in Japan have continued to use the excuse of “regulating Taiwan-Japan Relations” in an attempt to imitate the US in promoting the formulation of the Japanese version of the “Taiwan Relations Act”.Under the lobbying of the Taiwan authorities,Japan has promoted the process of “Taiwan Relations Act” by means of “duck paddling”,and has successively experienced the main stages of “pro-Taiwan scholars brewing”,“right-wing groups promoting” and “parliamentarians’ political operation”.Although there are many versions of “Taiwan Relations Act”,they always focus on sensitive issues that obviously violate the One China principle.on such issues as “Taiwan’s status、Intelligence sharing and Security cooperation”.“Anti-China” scholars,right-wing think tanks,and “pro-Taiwan” parliamentarians are the main forces behind the scenes advocating Japan’s “Taiwan Relations Act”.Under the background of Sino-US strategic competition,the promotion process of Japan’s “Taiwan Relations Act” has also shown a trend of “from dark to bright”,which makes the Taiwan related legal risks endangering Sino-Japanese relations “surface again”.
