关于消费品质量担保规定的探讨

摘要 在国家市场监督管理总局2022年的立法计划中,启动了《消费品修理更换退货责任规定》的制定.本文结合前期学者和笔者的研究工作,探讨了纳入规定的消费品范围、适当保留目录制、确定质保担保的期限、设定起始价格、优化修理更换退货顺序和允许其他责任承担方式等内容,希望能够对《消费品修理更换退货责任规定》的制定提供有益的建议. According to the legislative plan of SAMR in 2022,the formulation of Regulations on Responsibilities for Repair,Replacement and Return Warranty of Consumer Goods has been initiated.Based on previous research of authors and other scholars,this paper discusses some critical aspects,such as the scope of consumer goods included in the regulations,appropriate use of catalog method,determination of the warranty period,setting of the lowest limit price,optimization of the repair,replacement and return order,and allowing other responsibility patterns,hoping to provide useful suggestions for the regulation’s formulation.
