摘要
在经济全球化加速以及新冠肺炎疫情影响的大环境下,整个社会对于灵活性强、就业门槛低的非标准劳动用工需求日趋增多。然而,因为存在认定滞后、社会保险的缺位、企业隐蔽性雇佣等问题,传统的劳动关系认定标准在面对新业态平台用工模式时会产生诸多劳动权益保障问题。本文通过探讨我国非标准劳动用工的规制路径,设计适合新业态平台用工的非标准劳动关系准入二阶层模式,以此降低社会保险的适用门槛,并以新非标准劳动关系为基础提出重点规制举措,以促进此类新用工模式的法律完善和争议解决。
In the environment of accelerated economic globalization and the impact of the new crown pneumonia epidemic,the demand for non-standard labor employment with high flexibility and low employment threshold has been increasing.However,because of the problems of lagging recognition,lack of social insurance and hidden employment of enterprises,the traditional labor relations recognition standards will create many labor rights protection problems in the face of the new industry platform employment mode.In this paper,we explore the regulatory path of nonstandard labor employment in China,design a two-class model of non-standard labor relations access suitable for new industry platform employment,so as to lower the threshold of social insurance application,and propose key regulatory measures based on the new non-standard labor relations to promote the legal improvement and dispute resolution of such new employment models.
