个人信息保护体系的政策网络分析——以个人信息保护法为分析对象

A Policy Network Analysis of the System of Personal Information Protection with Special Reference to China’s Personal Information Protection Law

数字化时代,信息集聚者拥有“上帝视角”,如同站在福柯“环形监狱”瞭望塔上,占据单向透明的俯瞰地位,具有击穿罗尔斯“无知之幕”的能量。个人信息保护法绘制了个人信息保护体系的制度框架。法律规定了行动者,个人信息保护法在立法目的确认个人信息权利属性、搭建个人信息保护治理型框架、确立国家网信部门核心行动者地位、构设以公权机关为主导的利益协调机制等方面具有重要的积极意义。个人信息保护法应立足网络纵轴、网络横轴、跨制度网络、跨国网络四个维度作适当调整,完善中央—地方核心监管部门的连贯性,强化多元行动者互动路径的畅通性,保障制度之间的衔接性,完善法律域外效力规则,搭建更有效的个人信息保护体系。

In the digital age,information aggregators have a “God’s perspective”,just like standing on the watchtower of the “circular prison” depicted by Foucault and occupying a one-way transparent overlooking position with the energy to penetrate the “veil of ignorance” depicted by Rawls.Against this backdrop,China’s Personal Information Protection Law maps out the institutional framework of the personal information protection system.The law stipulates the actors,and accordingly the Personal Information Protection Law has important positive significance in terms of the legislative purposes to confirm the attributes of personal information rights;build a governance framework for personal information protection;establish the core actor status of the national cyberspace administration department;and construct a coordination mechanism of interests led by governmental agencies.In order to build a more effective personal information protection system,the Personal Information Protection Law should be appropriately adjusted based on the four dimensions of the network vertical axis,the network horizontal axis,the cross-institutional network,and the cross-border network;improve the coherence between the central and local core regulatory authorities;and strengthen the smoothness of the interaction paths of multiple actors,ensure the connectivity between systems,and improve the rules of extraterritorial effect of laws.
