扩大医疗服务业开放的现实逻辑与路径选择

Realistic Logic and Path Option for Expanding the Opening up of Medical Services

推动医疗服务业高水平开放,有利于促进我国多元化办医格局的有序展开,保障健康中国战略目标的实现。其不仅可以满足日益增加的多层次医疗服务需求,也有利于我国引进外资,推动更高水平开放型经济新体制建设。WTO的GATS奠定了全球医疗服务贸易的规则框架基础,其后的诸边与区域协定中的医疗服务规则对GATS有一定的突破,并呈现出多样化、标准的趋同化特征与发展趋势。《中欧全面投资协定》(CAI)中我国承诺在部分城市取消外资医疗机构的股权比例限制,意味着我国将加速推进医疗服务业开放。鉴于当前我国医疗服务业开放发展质量不高的现状,可参考《关于完成服务贸易国内规制谈判的宣言》的相关规定,在准入阶段逐步取消对外资医疗机构的股权比例限制;明确外资医疗机构职能,为外资医疗机构制定更加细致化的医疗资源设置引导清单;进一步优化“放管服”改革,简化审批机制,消除外资医疗机构在华发展堵点;以内地/大陆与港澳台地区相关协议为基础,推动对港澳台地区医疗服务业的高标准开放,满足人民群众多元化的医疗服务需求。

Promoting the high-level opening of medical service industry is conducive to promoting the orderly development of the diversified medical service structure in China and ensuring the realization of the strategic goal of healthy China.It can not only meet the increasing demands of multi-level medical services,but also be beneficial to the introduction of foreign investment and promote the construction of the new system of an open economy at a higher level.WTO's GATS has laid the foundation for the rule framework of global trade in medical services.The medical service rules in subsequent plurilateral and regional agreements have made a certain breakthrough to GATS,and show the characteristics and development trend of diversification and standard convergence.In the Comprehensive Investment Agreement between China and Europe(CAI),China promised to remove the shareholding limit of foreign-funded medical institutions in some cities,which means that China will accelerate the opening-up of the medical service industry.In view of the current situation that the opening and development of medical service industry is of low quality,we can refer to the relevant provisions of"Declaration on Completing the Negotiations on Domestic regulation of trade in Services",and gradually cancel the equity proportion restriction of foreign medical institutions in the access stage.Clarify the functions of foreign-funded medical institutions,and formulate a more detailed guide list for the establishment of medical resources for foreign-funded medical institutions;We will further optimize the reform of the Regulation and service sector,simplify the approval mechanism,and remove obstacles to the development of foreign medical institutions in China.On the basis of relevant agreements between the two sides of the Taiwan Straits and Hong Kong and Macao,to promote high standards of opening-up to Hong Kong and Macao,further promote the opening-up of the medical services sector,and meet the diverse needs of the people for medical services.
