论大数据企业协助侦查的隐患与风险应对

On the Potential Dangers and Risk Response of Big Data Enterprises in Assisting Investigation

侦查机关要求大数据企业以“协助侦查”之名,全面介入刑事侦查已成为大数据时代侦查活动的特征之一。大数据技术为侦查中的信息处理带来了新的动能,大数据企业凭借其成熟的大数据技术为侦查机关提供数据收集与数据挖掘服务。相较于侦查机关自建数据库模式,大数据企业协助模式还具有收集、分析数据的技术优势与弥补刑事司法协助制度缺陷、降低强迫自证其罪可能性的法律制度优势。但大数据企业参与刑事侦查活动存在着加剧个人信息脱离权利主体、数据共享主义泛滥以及盲目依赖算法结论等隐患。为避免此隐患,建立统一的大数据企业智库,通过构建分类分级数据调取规则、设置单向数据咨询服务机制、规范数据结论审查标准等方式,规制大数据企业参与侦查的行为,也许是当下可行的应对措施。

It has become one of the characteristics of investigation activities in the era of big data that investigation organs require big data enterprises to fully intervene in criminal investigation in"the name of asisting investigation".Big data technology has brought new momentum for information processing in investigation,big data enterprises provide data collection and data mining services for investigation organs with their mature technology.Compared with the self-built database of investigation organs,the big data enterprise assistance model also has the technical advantages of collecting and analyzing data and the legal system advantages of making up for the defects of criminal judicial assistance system and reducing the possibility of forced self-incrimination.However,the participation of big data enterprises in criminal investigation activities has hidden dangers such as exacerbating the separation of personal information from the subject of rights,the proliferation of data sharing and blindly relying on algorithmic conclusions.In order to avoid this,a unified big data enterprise think tank is established to regulate the behavior and measures of big data enterprises participating in investigation by constructing classification and classification data acquisition rules,setting up one-way data consulting service mechanism,and standardizing data conclusion review standards.
