摘要
河北省是跨国公司投资的重点区域,我国员工在跨国公司中占比较多。河北省有的跨国公司因追求利润最大化,在用工方面存在劳动强度大、克扣工资、忽视劳动权益保障等问题,引发了跨国公司劳资关系纠纷,严重影响了地方经济高质量发展。在跨国公司劳资关系的工种划分、薪酬待遇、涉外劳资等用工劳动权益保障及法律问题中应明确跨国公司是国内法人公司,与国内其他公司法律地位相同,受我国法律管辖;应督促跨国公司积极践行联合国及国际公约相关原则,遵守劳动保护法律法规,建立健全公司工会组织,以保护我国劳动者合法权益。
Hebei Province is a key area for multinational companies to invest,and Chinese employees account for a high proportion in multinational companies.In the pursuit of profit maximization,some transnational corporations in Hebei Province have such problems as high labor intensity,skimping wages and ignoring the protection of labor rights and interests,which have led to disputes over industrial relations among transnational corporations and seriously affected the high-quality development of local economy.It should be clarified that a transnational corporation is a domestic legal person,who has the same legal status with other domestic companies andis governed by the law of our countryon legal issues of employment and rights and interests protection of multinational corporations,such as the division of labor relations,remuneration packages,foreign labor and capital,etc..In order to protect the legal rights and interests of Chinese workers,transnational companies shall be urged to actively practice the relevant principles of the United Nations and the international convention,abide by the laws and regulations of labor protection,and establish and perfect the labor union organization.
