指导性案例适用表达的“自说自话”及其反思--基于6593份民事判决书的文献计量学研究

Guiding Cases’Self-Talk Phenomenon:Bibliometric Research Based on 6593 Civil Judgments

基于6593份包含“指导性案例”的民事判决书可以看出目前指导性案例的适用存在“自说自话”的特点,也即裁判文书中往往只有当事人对于指导性案例的提及或者法院对于指导性案例的提及,而很少同时出现双方观点,这意味法官不愿意在判决书中主动详细记录是否应该参照指导性案例的原因与讨论。这一现象虽然能够节约法官写作判决书的成本,但是最终会导致社会信息成本的增加。通过合理分担指导性案例是否应该参照的说理成本有助于改善这一问题。

Based on 6593 civil judgments including guiding cases,it can be seen that the application of guiding cases has the characteristics of self-talk phenomenon.That is,in the judgment documents,there is often only the reference of the parties to the guiding case or the reference of the court to the guiding case,and there are few views of both parties at the same time,indicating that the judge is unwilling to take an initiative to record in detail in the judgment whether the reason of the guiding case should be applied.Although this phenomenon can save the costs of judges’writing judgments,it will eventually lead to the increase of social information costs.This problem can be solved by reasonably sharing the reasoning costs of whether guiding cases should be applied.
