电影的短视频传播丰富了短视频平台的内容生态,也为当前一些电影拓展了新的传播渠道。但是,短视频平台上电影的二次编辑和创作往往面临忽视版权等问题。文章从价值层面与操作层面分析了短视频电影二次创作行为中的问题,价值层面短视频电影二次创作的本质是一种“偷猎”行为,而操作层面,由于二次创作者涉及对电影内容的剧透与解读误导,可能对版权方的经济收益带来直接冲击。最后,文章指出了二次创作侵权问题的解决路径,即短视频平台与影视平台加强合作,同时引导作者以影评类和影评专业分析类为二次创作生产类型导向。

The short video dissemination of movies enriches the content ecology of short video platforms,and also expands new dissemination channels for some current movies.However,the secondary editing and creation of movies on short video platforms often face issues such as ignoring copyright.This paper analyzes the problems in the secondary creation of short video movies from the value level and the operation level.The essence of the secondary creation of short video movies at the value level is a kind of“poaching”behavior.Spoilers and misleading interpretations of movie content may have a direct impact on the economic benefits of copyright owners.Finally,the article points out the solution to the problem of secondary creation infringement,that is,to strengthen cooperation between short video platforms and film and television platforms,and at the same time guide the author to take film critics and professional analysis of film critics as the type of secondary creation and production.
