总承包商视角下EPC总承包工程项目的合同风险管理

CONTRACT RISK MANAGEMENT OF EPC PROJECT FROM THE PERSPECTIVE OF GENERAL CONTRACTOR

EPC总承包模式已经成为国内建设、国际工程中最常见且先进的施工管理模式,其单一责任制的特点决定了总承包商要特别重视合同风险管理。应用合同风险管理的知识总结对比合同风险识别的方法,并基于我国《示范文本》对合同风险因素进行识别和分类,得到《示范文本》合同风险清单。进一步与国际FIDIC银皮书合同进行比较,分析《示范文本》“走出去”的可能性。

EPC mode has become the most common and advanced construction management mode in domestic construction and international projects.The characteristics of the single responsibility system determine that the general contractor should pay special attention to contract risk management.This paper uses the knowledge of contract risk management,summarizes and compares the methods of contract risk identification,and identifies and classifies the contract risk factors based on the Model Text of the EPC contract issued in China,and obtains the contract risk list.The possibility of"going global"of the Model Text is analyzed by comparing it with international FIDIC Contract(Silver Book).
