教育法治建设以良法善治为出发点和落脚点,是全面推进依法治国的重要组成部分。党的十八大以来,我国教育法的调整域不断拓宽,中国特色社会主义教育法治体系恢宏图景不断绘就,彰显了政治性鲜明、人民性坚定、公正性保证的教育法治理念。现阶段,我国教育法律制度建设呈现出教育行政法律关系愈发明确、学校教育法律内容不断丰富以及社会主体教育权利义务日益明晰的新样态。与此同时,我国教育法治行动展现出法治政府建设成效显著、依法治校深入开展以及法治保障不断强化的新气象。立足于新时代新形势新要求,我国教育法治建设应坚持习近平法治思想指导,加快推进教育法法典化的进程以及提升教育法治行动效能,努力开创依法治教新局面。

The construction of the rule of law in education takes good law and good governance as the starting point and foothold,and is an important part of comprehensively promoting the rule of law.Since the 18th National Congress of the CPC,the scope of adjustment of China’s education law has been continuously expanded,and the magnificent picture of the socialist education rule of law system with Chinese characteristics has been continuously drawn,highlighting the concept of the rule of law in education with clear political nature,firmness of the people’s nature,and guarantee of fairness.At this stage,the construction of China’s education legal system has shown a new pattern in which the legal relationship between education administration and education is becoming more and more clear,the content of school education laws is constantly enriched,and the rights and obligations of social subjects in education are becoming clearer.At the same time,China’s education rule of law action has shown remarkable results in the construction of a rule of law government,the in-depth development of schools according to law,and the continuous strengthening of rule of law guarantees.In the new era,new situation and new requirements,the construction of the rule of law in education in China should adhere to the guidance of Xi Jinping Thought on the Rule of Law,accelerate the process of codification of education and improve the effectiveness of rule of law actions in education,and strive to create a new situation in governing education according to law.
