“后扶贫时代”川陕革命老区法律援助实践路径研究

A Study of Legal Aid Practice Path in Sichuan-Shaanxi Old Revolutionary Base Area in“Post-Poverty Alleviation Era”

法律援助与扶贫有着深厚的渊源,后扶贫时代的川陕革命老区,法律援助与扶贫工作将长期相互交织,相互促进。随着老区经济社会的发展,法律援助已不能适应新变化新要求。受历史和传统影响,无论是政府、帮扶人员,还是贫困群众,都缺乏基本的法治意识,扶贫工作更多的是政策性取向,行政权力主导,运行操作不尽规范,公共法律服务体系建设也尚未成型。笔者以为,加强和改进法律援助本职工作,做到应援尽援,应援优援是必然要求,而更为重要的是,在法律援助外延方面,提高法治意识、强调扶贫政策注重运用法治思维和法治方式、完善公共法律服务体系,是推进老区法律援助工作有效的实践路径。

Legal aid and poverty alleviation have a deep origin.In the Sichuan-Shaanxi Old Revolutionary Base Area in the post-poverty alleviation era,legal aid and poverty alleviation work will be intertwined and promote each other for a long time.With the development of economy and society in the old areas,legal aid has been unable to adapt to the new changes and requirements.Under the influence of history and tradition,no matter the government,the aid workers,or the poor people,all lack basic awareness of the rule of law.Poverty alleviation work is more policy-oriented,dominated by administrative power,and not standardized in operation.The construction of the public legal service system has not yet taken shape.The author thought,to strengthen and improve the legal aid work,do who do assistance,who best signing is the inevitable requirement,but more importantly,in terms of legal aid extension,improve the rule of law consciousness,paying attention to poverty alleviation policy using the rule of law thinking and way of the rule of law,perfect the public law service system,is to promote the practice of legal aid work effectively in old path.
