为研究标准与专利融合的机制,本文通过分析标准与专利融合的基础和融合的总体路径,探究政府引导、市场主导下的标准与专利融合模式,以及标准的运营引导专利实施、标准的制定指导专利布局两类标准与专利融合路径。提出标准与专利融合在政府引导、市场主导和机构参与等方面的建议措施,为标准与专利融合工作的开展提供参考。

In order to study the mechanism of the integration of standards and patents, this paper not only analyzes the basis of the integration of standards and patents, but also explores the modes of standard and patent integration that is government-led and market-oriented. It explores the two paths for standard and patent integration in which standard operation guides patent implementation, and standard development guides patent layout, puts forward suggestions and measures for the integration of standards and patents in terms of government guidance, market leadership and institutional participation, so as to provide reference for the development of standard and patent integration.
