环境保护视角下施工企业刑事合规改革的逻辑与展望

Logic and Prospect of Criminal Compliance Reform for Construction Enterprises under the Perspective of Environmental Protection

从我国企业刑事合规改革实践来看,施工企业环保合规整改已经成为我国企业合规改革的重点。受到规范性依据不足、企业合规整改计划缺失等因素的影响,目前我国施工企业环保刑事合规整改的效果并不理想,难以实现预期目标。故此,为了有效提高施工企业环保合规改革的质量和效率,需要深刻把握施工企业环保整改的底层逻辑,借鉴国外施工企业环保合规整改的有益经验,从事前合规建设、合规考察标准、企业腐败治理三个方面展望我国施工企业环保合规的改革工作。

Based on the practice of China's enterprise criminal compliance reform,environmental protection compliance rectification of construction enterprises has become the key point of enterprise compliance reform.Due to the lack of normative basis,plan and other factors,the current rectification effect is not satisfactory,and it is difficult to achieve the targets.Therefore,in order to effectively improve the quality and efficiency of construction enterprise reform of environmental compliance,based on the grasp of the underlying logic of environmental protection rectification and the reference of foreign beneficial experience of rectification,we should look forward to the reform for environmental protection compliance of construction enterprises from three aspects:pre-compliance construction,compliance inspection standards and corporate corruption control.
