平台经济视域下相关商品市场的界定--以阿里巴巴案为切入点

Definition of Relative Markets in the View of Platform Economy--Taking the Case of Alibaba as an Example

经济平台特有的网络效应、多边平台结构和免费经济模式为反垄断执法带来了很大的阻碍。阿里巴巴案是《国务院反垄断委员会关于平台经济领域反垄断指南》颁布后一次有益的尝试,但在认定相关商品市场环节中仍存在未确定平台核心商品、仅依靠逻辑判断等缺点。在界定平台相关市场时,应以确定“产品”为出发点,根据交叉网络效应划定平台相关市场数量,并选择最终待探讨相关商品市场。在分析过程中,应注重定性分析和定量分析相结合,以替代性分析为基础,以SSNIC分析法为工具,做出合理的判断。同时,行政执法机构应当创建内部数据收集分析部门,真正提高监管能力。

The economic platform has brought great obstacles to anti-monopoly law enforcement due to its unique network effect,multilateral platform structure,and free economic mode.The case of Alibaba is a useful attempt after the promulgation of“the guidelines of anti-monopoly in the field of platform economy by the anti-monopoly Commission of the State Council”.However,there are still some shortcomings in identifying the relevant commodity market,i.e.,not determining the core commodities of the platform and relying only on logical judgment.When defining the platform related market,we should take the determination of"products"as the starting point,designate the number of platform related markets according to the cross-network effect,and select the final relevant commodity market to be discussed.In the process of analysis,we should combine the qualitative analysis and quantitative analysis together,and make reasonable judgments based on alternative analysis by using the SSNIC analysis method.At the same time,administrative law enforcement agencies should create internal data collection and analysis departments to truly improve their regulatory capacity.
