人民法庭高质量发展的公共法律服务体系建构——以基层社会治理的中国式法治现代化建设路径为视角

Construction of a Public Legal Service System for the High-quality Development of Dispatched People’s Tribunal——From the Perspective of the Chinese-style Rule of Law Modernization Path of Grassroots Social Governance

在法治轨道推进基层社会治理体系和治理能力现代化,应当重点关注人民法庭的公共法律服务功能和体系建构。人民法庭处在服务基层社会治理的最前沿,在我国现行国家基层政权组织体系的基本构架中,基层司法制度依然还是一个现代国家制度体系建构相对较为薄弱的环节。加强人民法庭融入、促进和引领基层社会治理工作,是加强基层政权治理体系和治理能力现代化建设的重要环节,是推进全面依法治国和法治体系建设应当重点关注的热点和难点问题,当然也是司法改革和社会建设亟待展开重点研究的现实课题。人民法庭的公共法律服务职能定位、制度协同、效能提升和体系建设,不仅是中国式法治现代化建设的重点和难点,而且也是国家基层政权组织建设和基层司法制度改革相对容易取得多赢效果的重要基础领域。

To promote the modernization of the governance system and governance capacity of grassroots social associations on the track of the rule of law,we should focus on the construction of public legal service functions at the interface of Dispatched People’s Tribunals,a special fi eld where justice goes to the countryside.The Dispatched People’s Tribunal is at a very important key point in the construction of China's modern nation-state,and in the basic framework of China's current national grass-roots political power organization system.The grass-roots judicial system is still a relatively weak link in the construction of modern state system.Strengthening the integration of,promoting and leading grassroots social governance work of Dispatched People’s Tribunals is an important link in strengthening the modernization of the governance system and governance capacity of grassroots political power,a hot and diffi cult issue that should be focused on in promoting the comprehensive rule of law and the construction of the rule of law system,and of course,it is also a practical topic that needs to be urgently studied in judicial reform and social construction.The public legal service function positioning,institutional coordination,effi ciency improvement and system construction of the Dispatched People’s Tribunal are not only the key and diffi cult points of China's rule of law modernization,but also an important basic area in which the construction of grass-roots political power organizations and the reform of the grass-roots judicial system in contemporary China are relatively easy to achieve win-win results.
