注册制时代的硬科技企业知识产权管理研究

Research on the Intellectual Property Management of Hard Technology Enterprises in the Era of Registration System

知识产权是硬科技企业的重要无形资产,是企业科创属性的重要体现。本文首先根据证监会对涉及知识产权事项的审核要点,论述了目前企业在知识产权管理上存在的问题,然后针对存在的问题提出相关建议。加强企业自身的知识产权储备,构建企业知识产权管理体系,做好上市前的主要产品侵权风险分析;特别指出企业要提前做好专利储备,需要围绕核心技术充分做好专利布局。随着注册制时代的到来,硬科技企业必将会创造更多的知识产权,因此,本文希望从资本市场角度,对企业的知识产权管理助力扬帆。

Intellectual property is an important intangible asset of hard technology enterprises and an important embodiment of the enterprise’s technological innovation attributes.Based on the review points of the China Securities Regulatory Commission on matters involving intellectual property rights,this paper discusses the current problems existing in the intellectual property management of enterprises,and then puts forward relevant suggestions for the existing problems.Strengthen the enterprise’s own intellectual property reserves,build the enterprise’s intellectual property management system,and do a good job in the analysis of the infringement risk of main products before listing;it is particularly pointed out that enterprises should prepare patent reserves in advance,and need to fully do a good job of patent layout around core technologies.With the arrival of the era of registration system,hard technology enterprises will surely create more intellectual property rights.Therefore,this paper hopes to help enterprises’intellectual property management from the perspective of capital market.
