赔礼道歉民事责任铸牢中华民族共同体意识的司法路径研究

基于法学、民族学和心理学等多元学科视角,《民法典》是铸牢中华民族共同体意识、实现中华民族伟大复兴的法律标杆。以赔礼道歉民事责任为例,其在司法实践中铸牢中华民族共同体意识的基本路径主要包括:通过传承和谐文化来铸牢中华民族共同体的集体潜意识;通过保护英烈人格利益来铸牢中华民族共同体的归属性意识;通过弘扬社会主义核心价值观来铸牢中华民族共同体的聚合性意识。

Based on such multi-discipline perspectives as law,ethnology and psychology,Civil Code is the legal standard of consolidating the consciousness of Chinese nation community and realizing the great rejuvenation of the Chinese nation.In the case of the civil liability of apology,it consolidates the consciousness of Chinese nation community in the judicial practice through the following paths:to consolidate the collective unconsciousness of Chinese nation community by inheriting harmonious culture;to consolidate the belonging consciousness of Chinese nation community by protecting the personality interests of heroes and martyrs;and to consolidate the cohesive consciousness of Chinese nation community by disseminating socialist core values.
