我国农村宅基地“三权分置”改革探索与困境破解--基于33个试点地区的改革举措分析

Exploration of the Reform and Solution of the Dilemma of“Three-right separation”of Rural Homesteads in China--On the Basis of an Analysis of Reform Measures in 33 Pilot Areas

农村宅基地“三权分置”改革是新时期我国农村土地制度改革的重要内容。2015年以来,全国33个农村土地制度改革试点地区针对传统宅基地制度的缺陷,在推进宅基地制度改革特别是“三权分置”改革试点方面进行了积极探索,这有助于把握各试点地区宅基地“三权分置”改革试点工作改革探索的实际情况。根据宅基地“三权分置”改革中面临的困境,提出如下建议:完善体制机制、优化改革举措、充实所有权权能、推进资格权立法、加快使用权流转、加强潜在风险防范。

The reform of“three-right separation”of rural homesteads is an important part of China’s rural land system reform in the new era.Since 2015,in China,in order to promote the reform of homestead system,active exploration has been made in 33 pilot areas of rural land system reform especially for the pilot reform of“three-right separation”in view of the defects existing in the traditional homestead system.Due to the dilemma encountered by the“three-right separation”reform of homesteads,it is proposed that we must improve the system and mechanism,optimize the reform measures,enrich the powers and functions of the ownership,promote the legislation of qualification rights,speed up the circulation of usufruct and strengthen the prevention of potential risks.
