对党内法规体系概念与结构的审思

Rflection on Concept and Structure of the System of intra-Party regulations

党内法规体系是当前党内法规研究中的核心与热点问题之一,党内法规体系概念的重要性源自于党内法规体系在法治体系中不可替代的地位;但党内法规自身远未形成和谐统一完备的规范体系,还不能充分满足法治建设对于体系性党内法规的迫切要求。为此,就必须首先从认识上厘清党内法规体系的概念,为党内法规体系建设提供一个总体性架构和立规实践理念基础。对此应从当前国内研究党内法规体系的多维结构思维路径进入,对诸学说进行反思性解析,党内法规要达成内容科学、程序严密、配套完备的体系化形态,须从政治权威、价值体系、逻辑关系、耦合融贯结构和外部体系等方面入手,将党内法规打造成价值同一、结构健全、逻辑周延、形态稳定的规范体系,为中国特色社会主义法治体系奠定高素质的规范要素基础。

The system of intra-Party regulations is one of the core and hot issues in the current research of intra-Party regulations.The importance of the concept of system of the intra-Party regulations derives from the irreplaceable status of the System of intra-Party regulations in the system of rule of law.However,the intra-party regulations themselves are far from forming a harmonious,unified and complete normative system,which cannot fully meet the urgent requirements of the rule of.Therefore,it is necessary to clarify the concept of the System of intra-Party regulations from the perspective of understanding,so as to provide an overall framework for the construction of the System of intra-Party regulations and the practical concept basis for making intra-party regulations.Thinking From the current domestic research path based on reflecting of the theory the intra-Party regulations,in order to achieve the desired goal of scientific content,rigorous procedures,form a complete set of system,only starting the study with the political authority,value system,logical relation,the coupling structure and external melt injection system and other aspects,can the intra-Party regulations be built into a normative system with the identical value,sound structure,strict logic and stable form,so as to lay a high-quality normative element foundation for the socialist rule of law system with Chinese characteristics.
