在合规改革背景下,可通过个人信息收集、提供和共享三个层面的规则构建,来防范智能技术应用于法院审判工作导致的信息安全风险。在智慧法院场景中,个人信息合规收集规则的核心是法律授权,其规范基础包括民法典、个人信息保护法以及专门的技术规范,可基于场景理论坚持“为履行法定职责所必需”收集个人信息;个人信息合规提供规则的核心是合理处理,包括借助数据脱敏、隐私计算和区块链等技术手段创新处理个人信息,以及通过信息公开前的利益衡量和利用合规理念强化技术赋能推进司法信息公开;个人信息合规共享规则的核心是分类分级,设置个人信息合规分类和分级机制,通过共享前的识别机制、共享中的传输机制与共享后的反馈机制所建立的合规共享流程,将合规共享理念贯彻于个人信息的全生命周期,降低案件失误率并提升司法效率。

In the context of compliance reforms,the construction of rules at three levels of personal information collection,provision and sharing can prevent information security risks caused by the application of intelligent technology to court trials.In the application of smart courts,the core of the rules for compliant collection of personal information is legal authorization,and its normative basis includes the Civil Code,the Personal Information Protection Law,and special technical specifications.Personal information may be collected based on the scenario theory insisting that it is"necessary to perform statutory duties".The core of the rules for providing personal information compliance is reasonable processing,including the innovative processing of personal information by means of technical means such as data desensitization,privacy computing,and blockchain.It also includes the promotion of judicial information disclosure by strengthening technical empowerment through the measurement of interests before information disclosure and the use of compliance concepts.The core of personal information compliance sharing rules is classification and grading.By setting up the personal information compliance classification and grading mechanism,and through the compliance sharing process established by the identification mechanism before sharing,the transmission mechanism during sharing and the feedback mechanism after sharing,the concept of compliance sharing is implemented in the whole life cycle of personal information,reduce the error rate of cases and improve judicial efficiency.
